Jarred... why would one (taxpayer) pay a federal tax on an allocation
of funds withheld to pay said federal tax on income? Are you stating
that income tax withheld and income are the same? Have I stated that
in this discussion? To me, it's helpful for one to think of "Federal
income tax withheld" as funds put aside later to be used in paying a
federal tax on income. It "simulates" being taxed.
Jarred... please share with me your knowledge on how an agreement to
withhold (i.e., one party being a withholding agent) may be created in
our commercial activities?

I have just recieved a letter from my credit card company informing me
that due to irregular repayments they have decided to lower my credit
limit. Can I ask is this an offer and should i conditionally accept it
upon a bonafide proof of claim or authorisation that they can lower it
without my consent? Also if this is correct then am I correct in
thinking this all remains in the public.

Yes, they have a lot of scarecrows out there. If you look at who they
are busting and why, its the real dolts that are getting strung up.
Not worth stopping for this, but it is worth putting on your thinking
cap real tight.

If you have a private judgment against the debt collector by way of
your admin. process you perfected, why go to court? The question is
just what is the best way to avoid it. There are several ideas out
there and I have tried none of them. But I might consider sending
back a conditional acceptance possibly including an affidavit in
negative form to the plaintiff privately and to the judge privately.
If court is nearby give to judges personal clerk or to main clerk with
cover sheet and mark private to Judge in chambers.
Or you may just send straight to clerk with no cover sheet publicly
because there may be no presumption that you need to abide with any
procedures because you are not in their jurisdiction and are not a
party to anything they are doing.
Anyone want to add or subtract from this?

I'm relatively new here as tax time approaches. Can anyone suggest
where one might find the following information:
Which IRS 1040 form should one file this year if one has both operated
in 2009 as both an LLC and a W-2ed employee, and also would like to
claim return on OID's?
I applied for my current mortgage in Oct 2005 and
"remodified" (including signing new docs to a 40 yr fixed in lued of a
30 year adj.) it this year. Where might one discover if it is yet
OIDable?
Where might one find information as to OIDability of student loans?
Where might one find information which may elucidate such issues as:
what accounts may be OID'd? Is there a limit to how many accounts may
be claimed each year? Does there need to be seperate 1099's for every
account, even if at the same institution?
Where might one find one's one's EIN as well as that of other
entities?
Where might one discover if the B/C process including lien needs to be
exicuted before any alleged 1099 process?

Recently I received an attempt to Levy from my bank. I currently owe
the IRS 5k from 2007. I've been hitting the AFV hard and still had a
question. Riddle suggests that we send the AFV to one or two of the 3
locations he has on his website. My question is that when I do the
AFV should I make it payable to United States Treasure or make it
payable to MN State Treasure. Seems like UST but someone else
mentioned that the UST cashed it and that didn't get the state paid.
Please only respond if you have an educated guess. Please no shooting
from the hip.

I'm also at this stage and am finding Brandon's advice slightly
lacking in appropriate detail. Brandon does a great cover letter and
Bond letter, but for those looking at it for the 1st time, the
variables and process raises many questions. Not a complicated
process to be sure, but probably it's still possible to screw it up
and render it ineffective.
Mcsilver's question really deserves a thorough answer. In other
words, put in writing the full process that works, what info goes
where, which - if any - get notarized, and so on. Am sure this
question will keep coming up until there's some clear document to
refer to. Also, I've heard one should 1st file some UCC statement
before the BC Bond.
Is this not the spirit of being creditors? Learn it right, do it
right, then help others... I'd love to pass on this blessing to those
who are ready.
