I am listening to an audio of Jack Smith at a retreat in Cleveland,
2009 November, 11th. In the retreat, workshop, seminar, whatever you
wanna call it, he said:

"I believe we've go three years to turn yourself around and become a
creditor, rather than a debtor. Because if you don't your window of
opportunity will close."

Why would that happen?

I have my own imagination as why that would happen but, I would like
hear everyone else's thoughts one why they think that would happen.

Why would the window of opportunity to become a creditor would be
closing somewhere in the near future say, 1-5 years. Jack put the
window to close at 2012 or at least around that time.

Do you even think the window of opportunity is even gonna close at
all?

Jack also talked about a situation where "they" are gonna come to our
homes and tell us that they gotta take our homes and put us somewhere.

How might that happen?

Well, I have my own imagination as to how that might happen and if you
interested, please free to ask. I'd be more than happy to share. But,
I would like to hear everyone's thoughts about what Jack is talking
about.

Strange. The ancient Mayan calendar predicted that the world would
come to an end in December 2012. Nostradamus also predicted the end of
the world in 2012. Several other studies and prophets have also
predicted the end of the world in 2012. None of them seem to have any
idea of how that is going to happen but there are no end of such
predictions
Could he have been reading the Mayan Calendar or Nostradamus?

If "they" were to do that then there would be no consumers to buy
their goods and services and "they" would all go broke in a big hurry
trying to support us. Even genocide such as Hitler tried costs a lot
of money and was what actually ruined Germany's economy more than
anything else. Had he put all those people to work instead of killing
them he might have had a vibrant economy. Instead he killed off his
work force and wasted Germany's resources in a useless war. I doubt
"they" will be so stupid as to do anything like that.

This poor guy has been in a Georgetown,Colo jail for 57 days now for
simply sleeping in his car at the ski resort. He faces 2 years in
federal prison and $250,000 in fines. This guy's a land lubber skier
out to hurt no one, and has no clue that his vessel in commerce has
just been boarded by maritime pirates out for profit and booty! Any
ideas on how to mount a defense or get this guy out (out to where I'm
not sure)? BC and A4V the charges? Plead guilty and pay fine with
pre-paid exemption? GSA forms? Ideas are needed! Thanks!

I believe he points to one success, which he discusses briefly in the
attached doc, "Creating trusts". It's what started him down this road.
They were in court trying to stop a foreclosure, and they got it
postponed. Here's what he says:
. A practical example; a mortgage foreclosure case, where foreclosure
sale was set before any documents had been filed, and the documents
were prepared that expressed the trust in three lines and a footnote
and case cites. The court construed the trust and appointed the
trustee as defendant. Our “Notice of Interest” (a statement that we
are expressing the trust), alleged that the defendant was the
beneficiary now, not the trustee, as the court had construed. The sale
was postponed two hours before it was set to go.
We determined that the reasons for the postponement were 1) any time
the trustee and the beneficiary are one and the same, the trust
freezes, or terminates. The court construed or implied the trustee to
be the defendant, where we came in and expressed the trustee to be the
beneficiary, freezing the trust.
2) More importantly, we filed the SOI, Statement of Interest, and that
has to be filed within 30 days of claiming the NOI, because the NOI
times out. This gives the court notice of a claim, so it could not
give free and clear title with a notice of adverse claim
SOI supports the fact that we are the grantor and the beneficiary.
That case collapsed, disappeared. (The SOI is CCI, Confidential
Commercial Information).

they are not verbatim, so, prima facia, can nay be construed as legal

other? Certainly the IRS and others are able to perfect processes in
the public - since obviously it's all contract. But if Affidavits in
public are heresay, how could they ever create a solid foundation for
a lien?

Would love to hear from someone who has perfected a public or private
process and executed a lien. I'm preparing to do my 1st.

An affidavit is hearsay, if not recorded in the public, not dishonored, and not sworn by a public official such as a notary. Everything can be considered hearsay if its not given by the individual who has first hand knowledge. Ive rarely seen private processes work, but to each its on. Just make sure if you make a claim against the treasury/us that it be congruent with the Federal Claims Act.

You say "we spear headed the process" but that definitely begs the
question of "Who gets the shaft?" Every spear has a shaft so who gets
the shaft in this one? The answer is, of course, those who blindly
follow the spearhead without doing any of their own research to find
out how valid the thinking might be or what the consequences might
be.

Everyone languishing in Club Fed got in that position because they did
the same thing. They failed to think. They failed to reason and they
failed to do their own research. They blindly followed some spearhead
and ened up getting the shaft.

Sender" when one does not what to contract with the Sender? I presume
RETURN TO SENDER would be written on the envelope, what if anything is

I really don't know where you are coming from on all of this and am
trying to understand the situation here. You realize of course that
the president of your HOA can't cash in that A4V anymore than you can.
Knowing this, aren't you dishonoring the original contract (I assume
there was one)? The reason we use judges, CFOs, IRS and the like is
because most of these people know exactly what to do with A4Vs. Put
yourself in the shoes of this guy. Has he not taken responsibility to
collect and appropriate funds for the betterment of the community? Did
you not agree to this at some point? How exactly do you feel justified
in dishonoring this/these individual(s)? Do you believe these
technologies are intented for us to all run around being irresponsible
and derelict in our duty to the communities in which we live? Forgive
me because I don't know the story here - I'm just going on the
information I have. Please help us understand what this is about. It
sounds like you are trying to perfect a process on someone who trying
to honor his responsibilities to the community... and from his
perspective you just gave him a bag of dirt and a xerox'd $500
Monopoly bill. Imagine when it's payday (assuming you work and receive
a paycheck) your boss came up to you and said "here's your paycheck...
it's an A4V... have a nice day. If you don't like it, argue and I'll
lien you up". Is that who we are?

The lowering can be done because your acceptance of the card terms
permitted them to do it. It's in there, I've looked. But I would say
yes, you can always conditionally accept changes in the contract. It
may not do any good unless you find some way to enforce it though.

I was thinking that maybe a4ving the sscard will give you more control
over the cestui que account and make the reality of getting every a4v
approved increase. Is this possible? Anyone try it? Maybe you can do a
bond with it like the BC but just change the numbers etc?

Jarred... why would one (taxpayer) pay a federal tax on an allocation
of funds withheld to pay said federal tax on income? Are you stating
that income tax withheld and income are the same? Have I stated that
in this discussion? To me, it's helpful for one to think of "Federal
income tax withheld" as funds put aside later to be used in paying a
federal tax on income. It "simulates" being taxed.

Jarred... please share with me your knowledge on how an agreement to
withhold (i.e., one party being a withholding agent) may be created in
our commercial activities?

I have just recieved a letter from my credit card company informing me
that due to irregular repayments they have decided to lower my credit
limit. Can I ask is this an offer and should i conditionally accept it
upon a bonafide proof of claim or authorisation that they can lower it
without my consent? Also if this is correct then am I correct in
thinking this all remains in the public.

If you have a private judgment against the debt collector by way of
your admin. process you perfected, why go to court? The question is
just what is the best way to avoid it. There are several ideas out
there and I have tried none of them. But I might consider sending
back a conditional acceptance possibly including an affidavit in
negative form to the plaintiff privately and to the judge privately.
If court is nearby give to judges personal clerk or to main clerk with
cover sheet and mark private to Judge in chambers.

Or you may just send straight to clerk with no cover sheet publicly
because there may be no presumption that you need to abide with any
procedures because you are not in their jurisdiction and are not a
party to anything they are doing.

Anyone want to add or subtract from this?

I'm relatively new here as tax time approaches. Can anyone suggest
where one might find the following information:

Which IRS 1040 form should one file this year if one has both operated
in 2009 as both an LLC and a W-2ed employee, and also would like to
claim return on OID's?

I applied for my current mortgage in Oct 2005 and
"remodified" (including signing new docs to a 40 yr fixed in lued of a
30 year adj.) it this year. Where might one discover if it is yet
OIDable?

Where might one find information as to OIDability of student loans?

Where might one find information which may elucidate such issues as:
what accounts may be OID'd? Is there a limit to how many accounts may
be claimed each year? Does there need to be seperate 1099's for every
account, even if at the same institution?

Where might one find one's one's EIN as well as that of other
entities?

Where might one discover if the B/C process including lien needs to be
exicuted before any alleged 1099 process?

Recently I received an attempt to Levy from my bank. I currently owe
the IRS 5k from 2007. I've been hitting the AFV hard and still had a
question. Riddle suggests that we send the AFV to one or two of the 3
locations he has on his website. My question is that when I do the
AFV should I make it payable to United States Treasure or make it
payable to MN State Treasure. Seems like UST but someone else
mentioned that the UST cashed it and that didn't get the state paid.
Please only respond if you have an educated guess. Please no shooting
from the hip.

Very important question from mcsilver and am glad someone has put it
plainly.

I'm also at this stage and am finding Brandon's advice slightly
lacking in appropriate detail. Brandon does a great cover letter and
Bond letter, but for those looking at it for the 1st time, the
variables and process raises many questions. Not a complicated
process to be sure, but probably it's still possible to screw it up
and render it ineffective.

Mcsilver's question really deserves a thorough answer. In other
words, put in writing the full process that works, what info goes
where, which - if any - get notarized, and so on. Am sure this
question will keep coming up until there's some clear document to
refer to. Also, I've heard one should 1st file some UCC statement
before the BC Bond.

Is this not the spirit of being creditors? Learn it right, do it
right, then help others... I'd love to pass on this blessing to those
who are ready.

I recommend you grab Winston Shrout's Ft. Collins DVD if you want to
see how that all works. You would try to get 2 others who were doing
the same thing and you would secure each other.
Lets ask ourselves what we are going to do once we send in these
docs. Are you ready to start issuing bonds and floating them to
people how may very well question your authority and possibly
investigate you? If we can explain why we are doing what we are doing
and where the authority springs from, then we are closer to being able
to do these things.

Yes sir! The only time ive see(only in my state of ga) a bank threaten
suit or repo and not go forward was because they felt they would lose
due to perfection of recission,issuance of us currency note, 1099a,

debtor ( a finance company into a debtor?). Anyone know how to turn

judicial state, get ready for the suit, if your in a non judicial state

If I have a line of credit based on a second mortgage I took out and
the finance company sends me a bill, technically they have no right to
and are simply bluffing because I did not sign an agreement stating
that I would pay themk the monthly amount or say that if I dont pay
they can take my property. If I decide to call them on this bluff then
they would then be liable and become the debtor and potentially have
to pay me the amount in question (50K). I know that I can A4V the bill
per Doug Riddles method but if I wanted to get the finance company to
actually have to pay me the 50K how would I go about calling their
bluff. What would be the process?

I have a good bond example, and was under the impression that filling
the UCC1 would register my bond making it public. The un-employment
is a good question I have the same type of questions regarding taking
any benifits from the state when trying to create your privite vessel

I've never listened to CW. What I get out of this is that instead of
just doing the AFV to the BC this might be a more effective way to
establish myself with the DTC. From your understanding would it make
since to be debt free and have utilities paid in advance before trying
this. I'm a little new and not making any moves for a bit ecept
IODing my 230k mortage and 36m of bank accounts. I came from the
freedom movement and now very intested in commerce. Do you listen to
CW? Have you been studing how to be a creditor for some time? What
are you thoughts on this call?

Find me just one man or woman or person or corporation or attorney or judge or grand jury that has read and understands all the codes, rules, procedures, local, state, and federal etc...

You will find none because it is impossible for any one to know. So what are we doing? Fighting a losing battle? If the common man, woman, person, corporation whatever cannot fully understand these alleged laws then they are all null and void and we are only playing the game that the vultures set up. These efforts are worthless because no one can totally understand all of these laws in it's entirety.

We, as the sovereign individual(no definition required), have no need for all of this bullshit. It's very simple. Did you make a contract? Did you say you would do this for that? Did you perform according to that agreement? If not you have a problem. Do you need to go search endless codes, statutes, alleged laws to find your remedy? NO!

Our peers will find and produce the remedy in deliberation between themselves. Not a judge, prosecutor, bogus grand jury under the direction of the alleged prosecutor, etc...

1) Were you a signatory to the Constitution for the United States? NO! If you did you are already dead.
2) Were you a signatory accepting all these alleged rules, codes, statutes, etc...? NO! What sane person would allow such?

3) Did you sign a document allowing someone else to do these things on your behalf even if it was against your will? I doubt anyone would accept this.

So where are we?

How about something as simple as this: We need food, clothing, and shelter period. Just enough to sustain our lives. The rest we can figure out within our local peer groups.

The rest is nothing but bullshit put out by bullshitters to take advantage of others and they are doing it constantly and this forum acknowledges this fraud and accepts it. Sad to say it but it's the truth.

We are to be beholden to none. If we wish to contract with someone then we will be held to the contract and we may allow our peers to oversee that contract. If you do wrong then you will be punished by your local peers period. If you don't want to be held to the opinions of your peers then nobody will contract with you and you are on your own which is totally acceptable. If you do harm to someone then your peers may take action against you to prevent another occurrence.

I am tired of all this and am taking on a new mindset. Do you want to contract with me? Great! If not, no big deal. But I refuse to be held to these bogus codes, statutes, etc... for which I was not a part of the process. It is all null and void.

So will you join me in the family of man or do you want to continue trying to figure out how to get around the system the vultures have created?

I'm tired and I've had enough. Why not just make a phone call to your Judges, Courts, Representatives, Senators, etc... and just say you don't agree and will not follow their bogus alleged laws and will defend yourself and your community against their control efforts.

with all of this "stuff".the entire OID portion is already understood and easily to find a
clear explanation of it by simply searching the group. Some people can also just search my name
or check out my posts and youll find me talking lots about OID.

Here are a couple resources and ideas that many don't know how to find things so here are my better solutions that may be of help to you:

Go on line and google it and find the phone number.
1.. Call the company and say you are interested in knowing about the bank and could they send you a portfolio.
2.. You can even buy 1 share and get their info on a regular basis.
3.. You can call a stock broker.
Now if you cannot find the number:
4. Call your local library and ask them the name, phone number, address.
5. Call the local chamber of commerce. They are wonderful and usually full of knowledge.
Here is one statement that is wonderful to get numbers: my accountant asked me for this. The people then feel like Oh, that is alright then.

I have a new idea or at least it is new to me. Let's have some comment
on it and see where we go with it.

If I go to court and file a motion and they charge me money I have
hired them to do something for me. Right? Therefore I become their
employer, do I not? why not wait until the end of the year or whenever
and turn in a 1099 to the IRS for the amount of any fines or court
costs? All we should need is their tax ID number which isn't hard to
get as I understand it.

I have no idea what would happen if we did that but it sure ought to
cause somebody some headaches. Just hope it don't turn out to be us.
(LOL)

Hello everyone.

There is a credit card I defaulted on. I tried to apply for a new
credit card with he same exact bank I defaulted with. Of course they
basically sent in a letter stating that they could not approve me for
the credit card I applied for because of credit obligations I had with
them has been delinquent.

I working on writing a letter to ask them if they could send me some
kind of bill or payoff statement, so that I can "settle" the
obligations and if they could agree to approve me of a credit card
upon condition the credit obligations are "settled".

Please share your thoughts, opinions, advice, suggestions, and
feedback if you have any.

Why is the IRS voucher form in your example different from the one
posted on Doug's website? It seems to be the same example but the
acceptance language is different in that it is not on a 45 degree
angle and it does not mention the exempt from levy verbage nor does it
show the SSN written with no dashes and then with dashes. Which is
the correct form?

trying to collect FRNs... I have to respond back to the court within 20
days. Lets just say that this is not my specialty and need some help on
responding to the plaintiff through the court..

My first issue is #1 the collection agency I guess is in the same town and
state as to where I reside so I would be definitely lying about this.
Opinions?
 
#6 has two blank spots and I am contemplating on what I am suppose to put
there. If it is as simple as I think it is then why is there blanks for the
simple phrases I was thinking of putting in there? Any thoughts?
 
The paragraph after #7 where it has red type, its says send a copy to some
senator. what for? I am thinking of just putting a period after seq. Unless
someone has a better idea?
 
The next paragraphs don't pertain to me so I was just going to delete them
including the evidence of falsification because I have no evidence.
 
where it says encls: I was going to delete number 1 and 2 and leave the
notice of demand to validate debt claim if I can find help on that..

All they are doing is saying I witness the sending of such document.
We have to go above the law ourselves and start sending REAL judges
our UCC 1-308 evidence that we did not allocute these agreements
ourselves. Let's start sending these to all REAL Judges so they know!
